Please read these Terms of Service carefully before using the afterSpark website or afterSpark platform. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms govern your access to and use of the afterSpark website at afterspark.ai and the afterSpark platform at app.afterspark.ai, operated by afterSpark LLC, a Colorado limited liability company.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.

3. License to Use the Service

afterSpark grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes and to build and operate commercial applications, integrations, and workflows.

4. Accounts and API Access

Certain features require an account. You agree to provide accurate information and keep your account credentials and API keys secure. You are responsible for all activity occurring under your account.

You may not resell raw API responses or use the Service to create a competing data product without our prior written permission.

5. Subscription Plans and Billing

Free endpoints are available without a credit card. Premium endpoints require an active subscription that renews automatically. Subscription fees are billed in advance and are non-refundable except where required by law. Credit packs expire on a rolling 12-month basis.

6. Customer Data

You retain ownership of any data, files, or information you upload to the Service.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

8. Intellectual Property

The Service and its content are owned by afterSpark and protected by intellectual property laws.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. afterSpark's liability is limited to the maximum extent permitted by law.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, United States.
